NATIONAL PLAN FOR TRANSITION, EMERGENCY RESPONSE, REPUBLICAN RESTORATION, AND DEMOCRATIC RECONSTRUCTION IN CUBA
OF THE CUBAN JURIDICAL-CONSTITUTIONAL GOVERNMENT FOR THE TRANSITION
ONE HUNDRED DAYS TO RESTORE THE REPUBLIC, REINSTATE THE RULE OF LAW, AND RETURN SOVEREIGNTY TO THE PEOPLE OF CUBA
Executive Summary
This plan outlines a constitutional, temporary, and non-partisan framework to restore republican legality, protect citizens, dismantle the repressive apparatus, address the humanitarian emergency, prepare free elections, and return sovereignty to the Cuban people.

The Cuban nation, subjected for decades to the usurpation of power, the destruction of republican order, the suppression of freedoms, political persecution, institutional manipulation, economic ruin, and the moral disfigurement of the State, has the inalienable right to recover the Republic, reestablish the supremacy of law, rebuild its institutions, and once again exercise its sovereignty through freely elected authorities.
The Cuban Juridical-Constitutional Government for the Transition assumes, before the Nation and before History, the exceptional duty of leading that process of national restoration. It does not do so to establish a new form of domination, to politically inherit transitional authority, or to transform itself into a future party, faction, or electoral platform. It does so solely to restore the Republic, protect the people, dismantle the repressive apparatus, reorganize the State, recover legality, repair the Nation, and return power in full to the Cuban people.
This Supreme National Transition Plan sets forth the doctrine, principles, structure, measures, limits, red lines, and operational phases of the republican restoration process, with particular focus on the first one hundred days, as well as the institutional preparation for free, fair, plural, verifiable, and auditable elections within a maximum period of eighteen months, or sooner if national conditions so permit.
The Cuban Juridical-Constitutional Government for the Transition is a provisional, exceptional, juridical, constitutional, temporary, and restorative authority, created exclusively to guide the transition from usurping rule to the full reinstatement of the Republic of Cuba under the rule of law.
Its legitimacy does not arise from any claim to permanence, but from the historic necessity of national restoration and from its commitment to dissolve itself once its mission has been fulfilled.
Its sole mission is to restore republican legality, reorganize the public powers, protect the life and liberty of the Cuban people, dismantle the apparatus of repression, recover national assets captured by the dictatorship, secure the institutional transition, organize free elections, and return sovereign power to the Nation.
The transitional government is not a political party, may not become one, may not act as an instrument for future electoral competition, and may not artificially prolong its own existence. Its authority is instrumental, limited, revocable by reason of its purpose, and extinguishable upon fulfillment of its mission.
The transitional mandate shall terminate as a matter of law once free elections have been called, effective guarantees for political competition are in place, the electoral process has been completed, the results have been officially recognized, and the new authorities arising from the will of the people have taken office.
The entire national transition shall be governed by the following higher principles:
Supremacy of Law. Every decision of the transitional government shall be subordinate to the restoration of republican legality and to the authority of legitimate democratic norms.
Popular Sovereignty. All authority exists to serve the people, and all transitional authority exists solely to return effective sovereignty to the people.
Temporality of Power. No transitional function may become a source of permanent domination or the political property of those who exercise it.
Order with Liberty. The transition shall not be synonymous with chaos, vengeance, or a power vacuum, but with legitimate authority, institutional discipline, and freedom under law.
Justice Without Impunity and Without Arbitrariness. There shall be no blanket erasure of major crimes, but neither shall there be punishment outside due process.
Truth, Memory, and Reparation. Cuba’s moral reunification requires that what occurred be clarified, documented, judged where it must be judged, and repaired for the victims.
Electoral Neutrality of the Transitional Authority. The transitional government shall organize political freedom, but shall not take part in the future competition for power.
Protection of Legitimate Property and the National Patrimony. Legitimate property rights shall be protected, and assets captured, diverted, or used to sustain oppression shall be recovered.
National and International Openness of the Republic. A restored Cuba shall be a nation open to law, lawful commerce, legitimate investment, international cooperation, and the dignity of its citizens both within and beyond the country.
In order to preserve the moral integrity of the process, no member of the Cuban Juridical-Constitutional Government for the Transition may, once the transition has concluded, found, join, promote, represent, or lead any political party.
Likewise, no member of the transitional government may seek elective office, act as an electoral operator, use provisional authority to build partisan leadership, or convert the restoration of the Republic into personal political capital.
The transition shall not be a ladder to power. It shall be an institutional sacrifice in service to the Nation.
During the first one hundred days, nine inseparable national objectives shall be pursued: restoring constitutional order; securing immediate legal protection for the citizen; reorganizing the State’s coercive apparatus; dismantling the structure of repression; recovering territorial, administrative, and documentary control of the country; addressing the humanitarian emergency; initiating economic recovery; preparing the free electoral process; and laying the foundations for transitional justice, national reparation, and accountability.
During the first seventy-two hours, the transitional government shall implement immediate institutional safeguarding measures to prevent a power vacuum, the destruction of evidence, the flight of those responsible, and the administrative disintegration of the country.
It shall order the lawful administrative assumption of control over government buildings, public registries, central archives, national state radio and television stations, ports, airports, prisons, customs facilities, telecommunications centers, identification systems, the public treasury, strategic depots, energy facilities, and security command nodes.
It shall order the immediate preservation of physical and digital archives linked to intelligence, counterintelligence, prisons, repression, judicial proceedings, state property, military-run enterprises, public finances, external debt, international contracts, concessions, and operations of the coercive apparatus.
The provisional authority shall be sworn in, and the senior organs of republican restoration shall be established.
The legitimate republican order shall be formally declared reinstated, and the political, moral, and juridical nullity of the structures that served the usurpation of power and the subjugation of the Nation shall be proclaimed.
The Executive, Judicial, and Legislative branches shall be provisionally reestablished under the principle of institutional restoration and separation of functions.
Provincial and municipal delegates shall be appointed with defined authority to ensure the presence of the transitional State throughout the national territory.
The Provisional Presidency shall provide political leadership for national restoration and represent the transitional authority before the Nation and abroad.
The Council for Republican Restoration shall coordinate the general action of the transitional State and the execution of this Plan.
The Provisional Court of Constitutional Guarantees shall provide urgent protection of fundamental rights and oversee abuses of authority.
The Provisional National Assembly shall exercise transitional normative functions limited to republican restoration and political oversight of the transitional government.
The Provisional Electoral Council shall prepare the process of free elections with functional independence, a republican legal foundation, and verifiable technical support.
The National Commission for Security and Defense Sector Reform shall supervise the vetting and reorganization of the coercive apparatus.
The National Commission for Truth, Responsibility, and Reparation shall document crimes and propose measures of justice and reparation.
The National Authority for Asset Recovery and Review of Regime Obligations shall administer recovered assets, intervened enterprises, and the review of odious debt.
The immediate release of political and conscience prisoners shall be ordered, together with the urgent review of arbitrary detentions and proceedings motivated by political reasons.
Special protection shall be provided to dissidents, journalists, jurists, activists, religious leaders, academics, and vulnerable citizens against possible reprisals.
Preliminary investigations shall be opened into torture, disappearances, executions, political imprisonment, systematic persecution, and other grave violations.
Due process shall be guaranteed even to those accused of serious crimes, because the Republic differs from tyranny in that it does not punish outside the law.
All armed, police, penitentiary, intelligence, or territorial control structures shall be immediately subordinated to transitional civilian command, to the supremacy of law, and to the absolute prohibition against acting as ideological or political instruments.
The Ministry of the Interior shall be immediately intervened, comprehensively audited, and fully reorganized. Illegitimate functions of repression, political espionage, and ideological surveillance shall be shut down.
Intelligence and counterintelligence structures shall be secured, classified, and vetted. Political surveillance of citizens, repressive infiltration of civil organizations, and any operation directed against peaceful civil society shall be prohibited.
The Armed Forces shall be preserved as an institution of national defense, but subjected to comprehensive doctrinal transformation, full subordination to civilian authority, and the removal of commanders implicated in political repression or grave crimes.
The police shall be transformed from an apparatus of political control into a body dedicated to the protection of citizens.
The penitentiary system shall be immediately intervened, and torture, incommunicado detention, deaths in custody, and other grave abuses shall be investigated.
A Provisional Border, Migration, and Customs Service shall be established to ensure administrative continuity, prevent the flight of those responsible for grave crimes, and facilitate the entry of humanitarian assistance.
The assets, enterprises, funds, concessions, and resources used to sustain domination, surveillance, repression, or the illicit enrichment of the ruling elite shall be subject to intervention, audit, safeguarding, and comprehensive legal review.
Recovered assets shall be directed primarily toward humanitarian assistance, reparations for victims, institutional reconstruction, restoration of basic services, and the strengthening of the Republic.
The restored Republic shall affirm that the Cuban people are not bound to bear obligations incurred for their own subjugation or to sustain the apparatus of repression.
Any debt, contract, concession, financing arrangement, or patrimonial commitment that materially served political domination, surveillance, repression, or the illegitimate enrichment of the ruling elite shall be subject to comprehensive review.
International structures, hotel chains, business groups, banks, technology providers, and multinational corporations that knowingly collaborated with the repressive apparatus may be subject to contractual review, nullification, suspension, or legal action in accordance with law.
Under the motto “The Republic Reborn,” the transitional government shall launch a national civic education campaign aimed at rebuilding civic consciousness, legality, authentic suffrage, public responsibility, and the moral value of liberty.
A Provisional Electoral Council shall be established with functional independence, a duty of absolute impartiality, and an obligation of public transparency.
The electoral process of the transition shall be organized on the basis of the republican principles of free, secret, direct, verifiable, and authentic suffrage, taking the 1943 Electoral Code as a reference to the extent that it is compatible with democratic restoration and with modern technical guarantees of electoral integrity.
The national voter registry shall be updated, and mechanisms shall be established for the participation of Cubans both inside and outside the island.
Registration shall be opened for parties, movements, and candidacies compatible with democratic order.
The electoral infrastructure shall operate with encrypted and coded applications, servers under the control of the transitional electoral authority, security protocols, access controls, traceability, and verifiable backup systems.
Verifiable voting platforms such as Helios Voting, or equivalent open-audit solutions, may be used, always under sovereign infrastructure or the direct control of the transitional electoral authority, with independent technical supervision.
The system must guarantee three essential things: that only those entitled to vote may do so, that each vote preserves its integrity and secrecy, and that the final result can be audited and verified without relying on blind trust.
The process shall include national and international observation, external technical review, verifiable auditing, and public verification mechanisms capable of confirming that the vote cast corresponds to the vote counted, without compromising the secrecy of the voter.
Electoral technology shall not replace juridical legitimacy; it shall reinforce it. The legitimacy of the process shall arise from the union of republican legal foundation, impartial administration, sovereign servers, encryption, international auditing, and public verification.
Free general elections shall be called within a maximum period of eighteen months. It is hereby established in unequivocal terms that the transitional government organizes electoral freedom, but does not participate in it.
First, the Provisional Electoral Council shall validate the voter registry and the registration of electors.
Second, the electoral authority shall operate on sovereign servers and encrypted systems, with technical control and institutional safeguarding.
Third, the voter shall cast his or her ballot under a system that guarantees secure identification, ballot secrecy, verifiable recordkeeping, and the possibility of subsequent audit.
Fourth, the counting and consolidation of results shall be subject to a multi-layered chain of control: the electoral authority, technical experts, national observers, and international observers.
Fifth, the final result shall be proclaimed only after audits, technical verifications, and system integrity controls have been completed.
Urgent assistance shall be requested in food, medicine, energy, potable water, hospital supplies, and essential technical support.
Priority shall be given to children, the elderly, pregnant women, the sick, released political prisoners, and families in situations of extreme vulnerability.
A Transition Economic Council shall be created to coordinate the country’s initial stabilization.
Strategic national assets shall be temporarily protected, and legitimate private property shall be guaranteed.
Diplomatic recognition of the transitional government shall be sought as the provisional authority for republican restoration, together with international technical support for institutional transition, the electoral process, and national recovery.
The National Commission for Truth, Responsibility, and Reparation shall be established to document grave crimes, propose measures of justice, consolidate institutional memory, and recommend reparations for victims.
The Cuban Juridical-Constitutional Government for the Transition may not become a political party.
None of its members may, in the future, belong to any political party or run for elective office.
There shall be no impunity for grave crimes, nor automatic immunity for the assets, contracts, or debts of the oppressive apparatus.
Every weapon, every force, every archive, and every strategic resource shall remain under republican authority, civilian control, and legal accountability.
Power shall be returned in full to the people of Cuba.
Once its mission of restoring republican legality, securing political opening, organizing free elections, and transferring authority to the representatives elected by the people has been fulfilled, the Cuban Juridical-Constitutional Government for the Transition shall cease entirely, definitively, and irrevocably in all of its functions.
This Supreme National Transition Plan has not been conceived to prolong exceptional rule, but to bring it to an end. It was not created to replace one form of domination with another, but to abolish domination itself. It does not arise to appropriate power, but to return it.
We do not assume power in order to inherit it. We assume it in order to restore the Republic, bring order to the transition, and return sovereignty in full to the people of Cuba.
